1. Acceptance
By accessing the website, submitting an inquiry, requesting a consultation, or purchasing services, you agree to comply with these Terms to the extent applicable. If you do not agree, you should not use the website or submit a service request.
2. Services
360 Emergence provides business consulting and strategic advisory services including Business Strategy Consulting, Operations Consulting, Business Process Optimization, Market & Competitor Research, Project Planning & Advisory, and Business Growth Consulting.
Services are advisory in nature and may include analysis, planning support, organizational guidance, research, and recommendations based on the agreed scope.
3. Scope and Project Terms
Website descriptions and starting prices are general information and are not binding proposals. Before a paid engagement begins, scope, deliverables, timing, fees, assumptions, and client responsibilities may be confirmed through a proposal, invoice, statement of work, or written communication.
Material scope changes may require a revised estimate, revised schedule, or separate engagement.
4. Client Responsibilities
Clients are responsible for providing accurate, complete, and timely information reasonably required to perform the services, reviewing deliverables, and responding to requests for decisions or clarification. Client-side delays may affect the delivery schedule.
5. Fees and Payment
Fees are based on the agreed project scope and may differ from starting prices shown on the website. Invoices are due according to the payment terms stated on the applicable invoice or proposal. Work may be paused if required payments are overdue.
6. No Guarantee of Results
No specific revenue, profit, market share, cost reduction, financing result, customer acquisition level, or growth outcome is guaranteed. Business performance depends on many factors outside the control of 360 Emergence.
7. Client Decisions
Clients retain responsibility for all business decisions, approvals, implementation choices, staffing decisions, financial commitments, contractual obligations, and operational actions. Recommendations are provided for consideration within the consulting scope.
8. Research and Third-Party Information
Research may rely on public sources, client materials, and other reasonably accessible information. Such information may change, may contain inaccuracies, and may not be complete. Research deliverables do not represent that every relevant source or development has been identified.
9. Intellectual Property
Unless otherwise agreed, 360 Emergence retains ownership of pre-existing methods, templates, frameworks, know-how, processes, and general consulting materials. Client-specific final deliverables may be used internally by the client after applicable fees are paid, subject to project-specific restrictions.
10. Confidentiality
Non-public information received from a client will be handled with reasonable care and used for legitimate purposes related to the engagement, administration, or legal compliance. Confidentiality does not apply to information that is public, independently developed, lawfully received from another source, or required to be disclosed by law.
11. Acceptable Use
You may not use the website to transmit unlawful, fraudulent, abusive, defamatory, infringing, malicious, or technically harmful material; interfere with website operation; attempt unauthorized access; or misrepresent identity or authority.
12. Third-Party Services
360 Emergence is not responsible for the independent availability, security, pricing, terms, performance, or policies of third-party platforms or service providers.
13. Limitation of Liability
To the maximum extent permitted by law, 360 Emergence will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost opportunities, loss of data, or business interruption arising from use of the website or consulting services.
Where liability cannot be excluded, total liability relating to a particular paid engagement will not exceed the fees actually paid for the specific services giving rise to the claim, unless applicable law requires otherwise.
14. Indemnification
You agree to be responsible for claims, losses, liabilities, or expenses arising from information or materials you provide, misuse of the website, violation of these Terms, or infringement of another party’s rights, to the extent permitted by law.
15. Suspension or Refusal of Service
360 Emergence may decline, suspend, or discontinue an engagement where requested work is unlawful, materially different from what was represented, outside the service scope, dependent on unavailable information, or subject to unresolved payment issues.
16. Changes to These Terms
These Terms may be updated to reflect changes in services, website functionality, operational practices, or legal requirements. The effective date at the top identifies the current website version.
